Welcome to PicForge! These Terms of Service (“Terms”) govern your access to the website, mobile applications, and services of PicForge (collectively referred to as the “Service”), provided by PicForge (“Company”, “We”, “Us”, or “Our”). Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Description of the Service: PicForge provides an artificial intelligence (AI) powered platform that allows users to create, modify, and optimize product designs, mockups, descriptions, and related commercial assets (collectively referred to as “Generated Content”) based on user-provided inputs, text prompts, images, or other information (“Inputs”).

2. Eligibility and Account Registration: You must be at least 18 years old (or have reached the age of majority in your jurisdiction) to use this Service. By creating an account, you represent and warrant that you possess the legal capacity to enter into this agreement. To access certain features, you must register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Inputs and Generated Content (AI Specifics): You retain all ownership rights to the text, images, or assets that you upload to the Service (“Inputs”). You grant PicForge a worldwide, royalty-free, non-exclusive license to host, store, use, and process your Inputs solely to provide, maintain, and improve the Service. Subject to your compliance with these Terms and payment of any applicable fees, PicForge hereby transfers to you all its rights, titles, and interests (if any) in and to the Generated Content. You are permitted to use the Generated Content for commercial purposes (e.g., selling products with these designs, marketing, listing on marketplaces), unless otherwise specified by your particular subscription plan.

AI Specifics Notice: You acknowledge that due to the nature of machine learning, Generated Content may not be unique, and the Service may generate the same or similar results for other users. PicForge makes no warranties regarding the copyrightability or exclusive ownership of AI-generated assets under local laws.

Financial Terms and Delivery :

5. Fees, Tokens (Energy), Payment Methods, and Delivery Terms:

Token Purchase: To use certain features of the Service, the purchase of tokens is required, which are consumed as energy for content generation. Current prices, token packages, and subscription plans are detailed on our platform.

Payment Methods: Payment for token packages (energy) can be made through the following methods:
• Google Pay — an instant payment method from Google;
• Apple Pay — a payment system from Apple;
• Payment Cards — bank cards of Visa, MasterCard, Prostir payment systems;
• Payment QR — mobile application payment via QR code;
• Botpay — payment in the Telegram bot via WayForPay;
• Cash Payment — payment by bank details at terminals or bank cash desks.

Token Delivery Terms: As the Service provides digital content and virtual values, no physical delivery takes place. Token delivery occurs automatically and instantly upon successful confirmation of the transaction by the payment system:
• Purchased tokens are credited directly to the internal balance of the User's account.
• Access to use tokens (energy) is granted immediately after they appear on the balance of the personal account.

Refund Policy: Due to the high computational costs associated with AI generation, refunds for the purchase of tokens and energy packages are possible exclusively within 7 days of payment and only on the condition that the purchased tokens have not been used. If the purchased tokens have been used for generation, or if more than 7 days have passed since the purchase, the transaction is considered final and the funds are non-refundable. Any disputes are reviewed on an individual basis at the discretion of PicForge.

Rights and Termination :

6. PicForge Intellectual Property: Except for your Inputs and Generated Content, the Service and all materials contained therein, including software, logos, trademarks, interface design, graphics, and proprietary algorithms, are the exclusive property of PicForge Inc. and its licensors.

7. Termination: We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for behavior that we believe violates these Terms, harms other users, or damages the business interests of PicForge. You can delete your account at any time in your account settings.

10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PicForge Inc. is officially registered, without regard to its conflict of law principles.

11. Changes to the Terms: We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document, or through an in-app notification or email. Your continued use of the Service after such changes are made constitutes acceptance of the new Terms.
